By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
PathRidgeOrbit offers a range of high-quality yacht charter services, which include:
- Day-to-day yacht rentals
- Evening sea voyages
- Business getaways
- Exclusive celebrations
- Extended sailing trips
Availability and execution of services are dependent on maritime conditions. We may adjust or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you are required to:
- Be at least 18 years of age
- Supply truthful and complete details
- Provide payment for the necessary deposit as indicated in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A confirmed booking ensues only upon our acknowledgment of your payment and issuing a confirmation message. We retain the authority to refuse services to anyone, subject to our judgment.
3.3 Availability
The option to book charters depends on the accessibility of the yacht and favorable weather for sailing. We strive to oblige your requested dates and hours.
4. Payment Terms
4.1 Pricing
All costs are stated in € and encompass relevant taxes unless specified otherwise. Pricing is susceptible to alterations without prior notification.
4.2 Payment Schedule
- Initial payment: Half of the complete charter cost needed at the time of booking
- Final amount: Payable 48 hours before the yacht leaves
- Extra fees (if applicable): Payable after the charter concludes
4.3 Payment Methods
We accept an array of payment means, including major credit cards, electronic funds transfers, and bank-certified drafts. The processing of payments is managed using safe, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before departure: Full refund minus processing fees
- 24-72 hours before departure: Half of the booking amount refundable
- Under 24 hours before departure: No refund issued
5.2 Weather Cancellations
When weather conditions are unsafe as determined by our captain, we will propose to either:
- Move your charter to a later date without extra charges
- Issue a total refund if rescheduling is impractical
5.3 Mechanical Issues
Should there be mechanical issues with the assigned yacht, we will make efforts to arrange an alternative. If replacement is not viable, a full reimbursement will be provided.
6. Safety and Conduct
6.1 Safety Requirements
All individuals on board must:
- Heed instructions from the crew
- Utilize safety equipment as requested
- Disclose any medical conditions potentially impacting their personal security
- Stay within the designated zones on the yacht
6.2 Prohibited Items
The following are not permitted on the yacht:
- Containers made of glass
- Illegal substances
- Weapons or firearms
- Excessive amounts of non-alcoholic drinks beyond normal provision
- Animals (unless clearance has been granted beforehand)
6.3 Conduct
Guests are expected to behave courteously. Should passengers' conduct pose a safety threat or significantly disrupt others' experience, we reserve the right to discontinue the charter prematurely without a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the sum paid for your charter. We are not liable for:
- Personal harm arising from the passengers' own carelessness
- The disappearance or destruction of personal items
- Indirect or punitive damages or those following as a consequence
- Delays attributable to weather or incidents outside our authority
7.2 Insurance Coverage
We carry comprehensive marine insurance for our fleet and operations. Individuals are advised to have personal travel and belongings insurance.
7.3 Assumption of Risk
Engaging in our yacht services implies acknowledgement of the intrinsic hazards associated with maritime activities and the acceptance of personal accountability for one's safety and welfare.
8. Modifications and Itinerary Changes
We maintain the authority to alter itineraries, paths, or schedules considering weather, safety, or operational needs. Efforts will be made to offer similar alternatives.
9. Force Majeure
Occurrences outside of our control, such as severe weather, natural disasters, government mandates, port closures, or mechanical failures, absolve us from any repercussions due to delays, cancellations, or changes.
10. Privacy and Data Protection
We manage your personal information following our Privacy Policy. Your use of our services signifies your consent to our data collection and usage as detailed in our Privacy Policy.
11. Intellectual Property
The content found on our website, including text, visuals, emblems, and images, is shielded by copyright and trademark regulations. Reproduction, distribution, or the creation of derivatives without our explicit consent is prohibited.
12. Governing Law
These Terms are subject to and construed under the laws of France. Disputes, if any arise, will be handled in the courts of Marseille, France.
13. Changes to Terms
We reserve the capability to amend these Terms when necessary. Any alterations will be noted on our website with the date they were updated. Continued service use after changes indicates acceptance of the new terms.
